On Monday, the Supreme Court handed down a decision that could have far-reaching implications for the intended immigration agenda of the Biden administration.
The Court has once again handed down a unanimous decision that is devastating to illegal immigrants here under protected status.
Justice Elena Kagan penned the unanimous decision, citing that current immigration law prohibits illegal immigrants residing in the United States under Temporary Protected Status (TPS) from being eligible to apply for green cards.
Permanent residence status has always been the end game for Democrats concerning illegal immigrants.
From the outset, we have maintained this was illegal, and the Supreme Court agrees.
Current federal laws require that all immigrants seeking green card status must have been “inspected and admitted or paroled” before seeking residency.
So, the 400,000 or so illegals that Dems want to make citizens will have to seek other means.
The first and ONLY Supreme Court opinion today is in Sanchez v. Mayorkas, a unanimous decision by Kagan holding that a TPS recipient who entered the U.S. unlawfully is not eligible under §1255 for LPR status merely because he has TPS. https://t.co/6W9WE6vLpx pic.twitter.com/fkHNitwyga

The case at hand involved a New Jersey couple, Jose Sanchez and Sonia Gonzalez.
The couple entered the United States illegally in 1997 from El Salvador, then applied for TPS status after earthquakes hit the country in 2001.
In 2014, they applied for green card status, making the argument that the couple had been “inspected and admitted,” but that was clearly not the case.
The unanimous opinion stated that there was “no dispute” that they had entered the country “unlawfully, without inspection,” so the initial denial by the Trump administration (and now the Biden administration) was the correct decision.
Kagan wrote, “The TPS program gives foreign nationals nonimmigrant status, but it does not admit them.
“So the conferral of TPS does not make an unlawful entrant … eligible.”
This specific issue has been a major sticking point when negotiating immigration reform, with Democrats having regularly called Republicans, specifically Trump, racist for blocking permanent status for these individuals.
So, I guess the entire Supreme Court is now racist by that standard.
It will be very interesting to see how Democrats react to this ruling, especially because it was unanimous and penned by a liberal justice.
